#JackSmith files critical brief in #Trump's DC case but remains under seal

Judge Chutkan orders Trump defense to respond to Smith’s new filings in elec conspiracy case. Response due Tues to Smith’s filing, Then response due Oct 10 to exhibits just filed by Smith

We likely wont see anything released publicly til Tue

Via Katie Phang:

Needless to say Chutkan not wasting any time..moving as quickly as she can w full consideration of fairness & due process for both sides

It's possible Chutkan will release the redacted filing – without its exhibits — soon after Oct. 1 (Tuesday). She set Trump's deadline to raise objections for noon that day, which is unusual timing if she's planning to just wait until after Oct. 10 to release the filing/exhibits.

Some tea-leaves reading on Judge Chutkan’s order & the govt’s now unsealed motion to seal.

We may see the govt’s redacted immunity brief in early Oct, but its huge appendix—4 vols. of exhibits—not till mid-Oct and, even then, much of that will remain redacted. I assume the appendix is huge because Chutkan gives Trump 10 additional days to post objections to it and because, according to the govt motion to seal, it seems to fill four volumes.

4/ Parloff (I'm only sharing some of the thread):

The govt anticipates—doubtless correctly—that Trump will raise holy hell about that, because, in Fla, govt asked Judge Cannon to seal both names *and* the content of “sensitive material.”

The govt claims the posture is different here than in FL bc 11th Cir case law differs from DC Cir case law & because the SCOTUS immunity ruling makes content crucial here. In any case, govt notes, in FL Cannon refused to seal the content despite its urgings
